SPECIAL ASSESSMENT RESULTS

This notice is written as directed by the Bay Scene Owners’ Association Board of Directors to inform you that the proposed special assessment that was mailed to the Membership on October 27, 2025, has PASSED. The purpose of the Special Assessment vote was to determine whether to implement a $41,400 per unit Special Assessment for the three (3) components listed below.

I. Additional funds required to complete the Special Assessment approved 9 August 2023.

II. Three projects categorized as New Requirements that result from unforeseen conditions and/or New Opportunities proposed to take advantage of the one-time situation of excavating much of the Bay Scene grounds and existing site improvements under the current 2023 Special Assessment.

III. Three projects derived from the Bay Scene Site Restoration / Improvements Master Plan, developed with the participation of a Bay Scene Steering Committee and presented to owners in May 2024 and currently available for viewing on the Bay Scene web site.

As you may be aware, a majority of the quorum of the entire membership was required to approve the special assessment. To achieve quorum, owners representing a majority of the units needed to cast ballots, and quorum was met with 73 homeowners turning in ballots, and 72 of 73 ballots were verified as valid.

The ballots were opened on Wednesday, January 14, 2026, at 6:00PM in-person at the onsite Clubhouse and the results of the ballots are as follows:

Approved: 42
Disapproved: 30

Thank you to all of those who participated in this important vote! A payment plan notice is included in these results. Each owner will have the option of paying the special assessment as follows: Twenty-four (24) equal consecutive monthly, no interest payments of $1,725.00 beginning March 1, 2026. Payments are due on the first day of each month.

The assessment value mentioned above is a separate obligation and in addition to per monthly assessment. The Owner is responsible for the entirety of the Special Assessment, should they choose to sell their unit prior to the assessment being paid in full. The monthly payment schedule for the $41,400.00 assessment is as follows:

• First payment will begin March 1, 2026.
Twenty-four (24) consecutive monthly payments of $1,725.00.

• Last payment will end on February 1, 2028

Important Notes:

o Monthly payments are due on the first of each month and will be considered late if not received by the fifteenth of that month.

o The Special Assessment monthly payments are in addition to the current monthly assessment of $1,440/month.

Are you on AUTO-PAY? Please make the necessary adjustments to your banking account used or linked for Association Assessment Payments. If you are enrolled in Auto Pay through AppFolio, using the setting “deduct outstanding amount,” the Special Assessment and Regular Assessment amount will be debited from your account automatically. If it is not, you will have to manually edit your payment amount each month and each time of payment. Management has included instructions on how to edit your payment within this notice.

Do you want to make your payments via check (personal or from your bank)? Please ensure payments are mailed to the following address and received prior to the 15th of every month, and please ensure your payments are made payable to the Bay Scene Owner’s Association.

You may make larger payments than required by the payment schedule described above, such as a large lump sum or total payoff prior to 2028. At any time if you are wanting to pay your balance in full, please contact Management to properly give you your payoff balance.
